On the processing of personal data and their retention in the recruitment process

SIA Avar Auto, reg. No. 50003623341, legal address: Gatves, Jaunmārupe, Mārupes Municipality, LV-2166 (hereinafter the Company), informs you about the processing of personal data in the recruitment process:

1. Personal data
All information contained in the CV submitted by you as well as information obtained from persons who have provided references about you, where you have expressly authorised contacting the persons concerned. If you are invited to a job interview, the information provided during the job interview, any completed tests and other testing materials shall be considered as your personal data.

2. Aim or purpose of processing personal data
For recruitment by the Company and securing its legitimate interests as far as recruitment is concerned.

3. Legal grounds for data processing

3.1. You are free to take part in the competition for the vacancy advertised (legal basis for data processing – your consent).

3.2. Upon the receipt of your application, the Centre acquires a legitimate interest in processing your application, evaluating the information provided in it, organising the meeting procedure, conducting the meeting and securing evidence supporting the legal course of the respective process. In the event of a dispute, the information obtained during the recruitment process may be used to demonstrate the legal course of the process in question.

4. Personal data recipients

If any complaints are received about the particular recruitment process, the information obtained and processed during the recruitment process (your personal data) may be transferred to the law enforcement or supervisory institutions (such as Data State Inspectorate), as well as to the court.

5. Transfer of personal data to a third country or an international organisation, and automated decision making

5.1. The Company does not intend to transfer personal data to third countries or international organisations in the recruitment process.

5.2. Automated decision-making in the recruitment process is not carried out by the Company.

6. Storage

6.1. All information obtained upon the candidate applying for the particular vacancy and/or providing additional information, for example during interviews, will be stored for a maximum of six months after the completion of the particular selection process in order to safeguard the legitimate interests of the Company. Following the principle of data minimisation, the Company undertakes to delete the relevant information after the legitimate interest is satisfied.

6.2. In the event where the Company receives complaints about a particular recruitment process, all information processed during the selection process (your personal data) will be retained:

6.2.1. Until the date of entry into force of the final decision taken in the proceedings instituted by the competent authority, provided that it is not appealed or challenged in the procedure and by the deadline set forth by laws and regulations, or

6.2.2. until the entry into force of the final court judgment.

7. Rights of the data subject (candidate)

7.1. You have the right to access your data, to request restricting data processing or to object to the processing of your data as well as the right to data portability and data rectification.

7.2. You have the right to lodge a complaint with the supervisory authority (Data State Inspectorate, Blaumaņa iela 11/13-15, Riga, LV-1011, info@dvi.gov.lv) regarding the activities of the Company if it violates your rights as a data subject, in accordance with the laws and regulations governing the protection of personal data.

7.3. Given that the legal grounds for the processing of personal data is your consent and the legitimate interest of the Company, you have the right to request deletion of the data.
